1. RENT & PAYMENT Rent is payable annually in advance unless otherwise agreed in writing. Late payment beyond 14 days of the due date may attract a fee as agreed between the parties. 2. CAUTION / SECURITY DEPOSIT A refundable caution deposit is held by the Landlord to cover damage beyond fair wear and tear. It is refundable within 30 days of the Tenant vacating, less any deductions for repairs or unpaid bills. 3. AGENCY & LEGAL FEES Where applicable, agency and legal fees (commonly around 10% + 10% of the annual rent) are payable by the Tenant at the commencement of the tenancy, in line with local practice. 4. DURATION & RENEWAL This agreement runs for the term stated above. Either party wishing to renew or terminate must give notice as set out in Clause 5. Renewal is subject to mutual agreement on updated rent, where applicable. 5. NOTICE TO QUIT Notice periods vary by tenancy type and are governed by the law of [State]. As a general guide: weekly tenancy — 1 week's notice; monthly tenancy — 1 month's notice; quarterly tenancy — 1 quarter's notice; yearly tenancy — 6 months' notice. Both parties should confirm the exact statutory requirement for their tenancy type and location before relying on this clause. 6. TENANT OBLIGATIONS The Tenant shall keep the property in good and tenantable condition, use it only for the purpose stated, not sublet or assign without the Landlord's prior written consent, and permit the Landlord reasonable access for inspection with notice. 7. LANDLORD OBLIGATIONS The Landlord shall ensure the Tenant's quiet enjoyment of the property and remain responsible for structural repairs and major maintenance not caused by the Tenant's negligence. 8. TERMINATION / BREACH Either party may terminate this agreement for a material breach (including persistent rent default) after appropriate notice, subject to the applicable law. 9. GOVERNING LAW This agreement is governed by the tenancy laws applicable in [State], Nigeria. 10. SIGNATURES By signing below, both parties confirm they have read, understood, and agree to be bound by the terms of this agreement.

Common Nigerian tenancy types

Pick the kind of tenancy to set the property type and rent frequency, then fill in the address, rent and dates.

01Per Annum

Residential flat, yearly

The most common Nigerian city tenancy — rent paid per annum.

02Per Annum

Self-contain, yearly

A single self-contained room or studio let by the year.

03Per Annum

Shop or office

Commercial premises — use limited to the business stated.

04Monthly

Monthly tenancy

Rent paid month by month — shorter notice periods usually apply.

Notice to quit

How much notice is needed?

In Nigeria, notice to quit generally runs with how often rent is paid — not how long the tenant has lived there. This is the general guide; some states, Lagos in particular, have their own tenancy laws.

Tenancy typeTypical notice
Weekly tenancy1 week's notice
Monthly tenancy1 month's notice
Quarterly tenancy3 months' notice
Yearly tenancy6 months' notice
Tenancy at willAt will — a reasonable period is still expected

Lagos: a second notice

Under Lagos State's tenancy framework, once the notice to quit expires the landlord must serve a further 7-day notice of the owner's intention to recover possession before going to court.

No self-help eviction

Even after valid notice, a tenant who won't leave can only be removed through a court order — never by changing locks or cutting power.

Rules differ by state and change over time. Confirm the current rule for your state with a lawyer before relying on it. Read our full notice-to-quit guide →

Avoid disputes

Where Nigerian tenancies most often go wrong

01

The wrong notice period

Notice runs with how often rent is paid. Serve too little and the whole eviction can be thrown out and restarted.

02

Deposit and fees left vague

Spell out the caution deposit, what it covers and when it is refunded, plus any agency and legal fees — the most common disputes.

03

No governing state

Tenancy rules differ by state. Naming the governing state tells both sides which law applies.

Questions

Frequently asked questions
